3. Payments

3.1 Payment Terms

• All payments are due within 7 days of the invoice date.
• Payments that are more than 14 days overdue will incur a 10% administrative fee on the total invoice amount.

3.2 Deposits

A deposit is required before any work on a project begins. The deposit amount will be specified in the project agreement or proposal. Work will only commence once the deposit is received.

4. Client Responsibilities

4.1 Content and Documentation

Clients are responsible for providing all required content for their projects, including but not limited to text, images, videos, legal documents and other media/material.

Elevate WebDev is not responsible for the content, policies, statements, or terms and conditions displayed on client websites. It is the client’s responsibility to supply or request any legally required documents for their website.

4.2 Compliance

Clients must ensure that all content and functionality requested for their website comply with relevant laws and regulations.

5. Project Timelines

Elevate WebDev will provide an estimated timeline for each project depending on current workload. Timely delivery depends on the client’s cooperation in providing necessary content, feedback, and approvals.

6. Subscription Plans

Elevate WebDev offers subscription plans for Website Maintenance, Social Media Management, and Digital Marketing services. By subscribing to these plans, you agree to the following terms:

• Subscription fees are billed as per the agreement signed at the start of the subscription.

• Prices for subscription plans are subject to an annual review. Any price changes will take effect from the start of the calendar year. Clients will be notified of any changes at least 30 days in advance.

• Subscriptions may be canceled when the client are no longer in need or want of the services.

• Failure to pay subscription fees on time may result in suspension or termination of services.

7. Intellectual Property

7.1 Ownership

Upon full payment of all invoices, clients will own the final deliverables for their project.

Elevate WebDev retains the right to showcase completed work in our portfolio and marketing materials unless otherwise agreed.

7.2 Licensing

Any third-party software, plugins, or tools used in the development of a project may be subject to their respective licensing agreements. Clients are responsible for adhering to these agreements.

8. Limitation of Liability

Elevate WebDev will not be held liable for:

• Any direct, indirect, or consequential damages resulting from the use of our services.
• Downtime or technical issues beyond our control.
• Any legal compliance issues arising from the lack of required policies or content on client websites.

9. Confidentiality

Both parties agree to keep confidential any proprietary or sensitive information disclosed during the course of a project.

10. Termination

Either party may terminate the agreement if the other party breaches these terms. In such cases, all work completed up to the termination date must be paid for in full.

11. Governing Law

These terms and conditions are governed by the laws of South Africa. Any disputes will be subject to the jurisdiction of South African courts.

12. Changes to Terms and Conditions

Elevate WebDev reserves the right to update these terms and conditions at any time. Changes will be posted on our website, and continued use of our services constitutes acceptance of the updated terms.
